INTRO

What Is Mediation?

Workplace disputes mediation is a form of alternative dispute resolution, which involves bringing a professional and unbiased third party into the workplace to resolve a problem between employer and employee.

It is a confidential and voluntary process, used once informal discussions have failed to come to a resolution. I am independent and impartial, and will discuss the issues with both employer and employee to find a solution that works for both parties.

Mediation provides a safe environment for both parties to air their concerns, needs and perspectives. When successful, it results in a stress-free and healthy work environment for, not only those in conflict, but the organisation as a whole by restoring the employer/employee relationship.

Is Mediation right for your dispute?

Mediation is economic in that it allows an employer to salvage a relationship with their employee. Instead of spending thousands of pounds to find a replacement and train a new hire, successful mediation results in a retained employee who is already a valuable member of the company.

Workplace mediation is much quicker than taking legal proceedings, so excess down-time and large chunks of employee absence are avoided.

As the process of mediation is confidential, informal and voluntary, it can’t be forced on an employer by the employee, nor can an employer force their employee to accept a solution. It is a mutually agreed process for both parties to find a solution they find acceptable to work towards.

Mediation can be used to resolve disputes including the following:
  • Disputes involving contract and termination
  • Breakdown in communication or team relationships
  • Harassment and bullying complaints
  • Inappropriate or discriminatory behaviour and language
  • Poor performance, attendance and/or time keeping
  • Personal misuse and/or abuse, of the internet or email
  • Theft
  • Drink or drug issues
  • Issues around taking credit for others’ work or ideas
  • Please note: this type of mediation is not legally binding and is not suitable for resolving problems that have gone so far as being investigated on a formal basis, such as allegations of victimisation or harassment.

How Workplace Mediation works

Step 1
I will discuss your issue(s) with the Human Resources team.

Step 2
I will hold a confidential session with each participant to understand their perspective.

Step 3
Where possible I will bring participants together to talk, listen and collaborate.

Step 4
We will work together to reach a mutually agreed outcome. If the appointment is successful, I will prepare an action plan for outcomes to work towards and, if appropriate, set a review date to ensure both parties are benefitting from the agreed solution.

I adopt a number of different approaches to mediation helping both parties to find solutions to enable them to work together in the future.
